Terms of Service for Writetastic

1. Acceptance of Terms

By accessing or using Writetastic ("the App"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not use the App.

2. Description of Service

Writetastic provides users with AI-powered tools to transform and enhance their writing ("the Service"). The Service is provided "as is" and "as available" without warranties of any kind.

3. Eligibility

You must be at least 18 years old to use the App. By using the App, you represent and warrant that you are at least 18 years old.

4. User Conduct

You agree not to use the App to:

• Violate any applicable laws or regulations.
• Transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable material ("Content").
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Distribute or transmit any unsolicited or unauthorized advertising, promotional materials, spam, junk mail, chain letters, pyramid schemes, or any other form of solicitation.
• Engage in any other conduct that restricts or inhibits any other person from using or enjoying the App, or which, in our sole discretion, exposes us or any of our users, affiliates, or partners to any liability, damage, or detriment of any type.

5. Intellectual Property

All content available through the App, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of Writetastic or its licensors and is protected by intellectual property laws. Unauthorized use of any content may violate copyright, trademark, and other laws.

6. License

Subject to your compliance with these Terms, Writetastic grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use the App for your personal, non-commercial use.

7. User Content

You retain ownership of any content you submit, post, or display on or through the App. By submitting, posting, or displaying content, you grant Writetastic a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in connection with the App.

8. Prohibited Uses

You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Attempt to gain unauthorized access to the App, other user accounts, or computer systems or networks connected to the App.
• Engage in any activity that could damage, disable, overburden, or impair the functioning of the App.
• Use any automated system, including without limitation robots, spiders, offline readers, etc., to access the App in a manner that sends more request messages to the Writetastic servers than a human can reasonably produce in the same period of time by using a conventional online web browser.

9. Termination

Writetastic reserves the right to terminate or suspend your account and access to the App at any time, with or without cause or notice, if we believe that you have violated these Terms or for any other reason, in our sole discretion.

10. Disclaimers

The App is provided on an "as-is" and "as-available" basis. Writetastic expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Writetastic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the App; (d) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party; (e) any errors or omissions in any content; and/or (f) any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the App.

12. Governing Law

These Terms and any disputes related to these Terms or the App will be governed by and construed in accordance with the laws of California, without regard to its conflict of law principles.

13. Changes to Terms

Writetastic reserves the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on the App. You are advised to review these Terms periodically for any changes. Your continued use of the App after the posting of changes constitutes your acceptance of such changes.
